We want to make your stay in a HolidayMakers' property as enjoyable as possible and we assure you that we will be working hard to do this. However, you will understand that to allow us to do this and also to maintain the standards of the properties for you and for future guests, we have to have some rules. Ours are based upon accepted industry practice and normal careful use of the property.
TERMS AND CONDITIONS
By paying the deposit you, the guest, have offered to rent the property described in the booking confirmation letter from us, HolidayMakers, acting as agent for the owner of the property, upon these terms and conditions. You also agree to be bound by these terms and conditions.
THE PROPERTY
The property is described in the HolidayMakers web site (www.holidaymakers.com.au) and the booking confirmation letter. Please check the web site and the booking confirmation letter carefully. While every effort has been made to describe the property accurately, we do not accept responsibility for any differences between the description and the actual property.
Similarly, we are not responsible if the accommodation that you choose does not meet your chosen style. To reduce the risk of this happening, please study the description of the property on the HolidayMakers web site, and/or ask us for details before you book.
All properties are different and some have special instructions to allow you to operate the utilities and services, or for safety. These are in the manual provided in the property, and you agree to follow these instructions.
We will not be responsible for the failure of utilities, essential services or appliances. We will take all reasonable steps to have the problem fixed if you tell us, but immediate repair may not be possible. We will not give you a discount on the rental if we cannot arrange a repair during your stay.
BOOKINGS AND PAYMENT TERMS
When we accept your offer to rent and receive your deposit, we will reserve the property for your exclusive use during the rental period. By paying the deposit, you agree to pay the balance of the rental fees by the due date specified in the booking confirmation letter. If you dont do so we will be entitled to assume that you have cancelled this agreement and forfeited all monies paid.
Payment by Mastercard, Visa, direct deposit and cash is welcome. We accept cheques provided we have 14 days to clear them. A surcharge of 3% for American Express and Diners applies if you use these cards.
If you chose to pay by credit card then you authorise us to complete any documentation for the purpose of a credit card system, and to amend and complete any credit card documentation for any charges including loss, damage or excess cleaning that you owe us under the terms of this agreement.
CHANGES AND CANCELLATIONS
We understand that it is sometimes necessary to change a booking. Should you wish to do so we will try to fit in with your needs, but if we cannot and you cannot continue with this booking then you understand that the cancellation conditions will apply.
If you cancel in writing at least thirty days before the start of your rental we will refund all monies that you have paid, less a $75 administration fee. The credit may be transferred to an alternative date within 12 months of the original booking. If the cancellation is later then you agree that we can keep the full amount that you have paid. However, if we can take a replacement booking we will refund to you an amount equivalent to the money received from that booking, less our reasonable administrative costs associated with your cancellation and the $75 administration fee, up to the amount of your money that we are holding.
Travel insurance is recommended.
SECURITY BOND
You must provide HolidayMakers with current credit card details for the security bond, to the amount specified in the booking confirmation letter, before the start of your rental. You give us authority to deduct from your credit card for losses or damage, and for any other costs that you have incurred with us. If the total of these charges is greater than the security bond, then you agree to pay the balance on demand from us. We have the right to retain the security bond until any potential or outstanding claims relating to your use of the property are resolved. For security reasons we do not accept personal or company cheques for security bonds. Please note that we reserve the right to increase the security bond for any groups which, we believe, fall into a higher risk category.
AVAILABILITY OF THE PROPERTY
We will make the property available for your use and in a clean and tidy condition at the start time and date shown in the booking confirmation letter. We reserve the right to substitute a similar property in the unlikely event that the property be unavailable for any reason. However, we may at any time cancel your booking if in our sole discretion there are reasons which require us to do so. If this happens we will give you a full refund of all monies that you have paid and we will have no further liability to you.
Keys can be picked up at the location given in the booking confirmation letter after 3 pm on the first day. Our office hours are 8.30 am to 5.00 pm six days a week, 10 am to 5 pm on Sundays. If you are going to arrive after 5 pm then you must make arrangements with us for the key to be picked up. Keys must be returned to the location also specified in the booking confirmation letter by 11 am on the last day. We will not make keys available if we do not have current credit card details for the security bond.
AT THE END OF YOUR STAY
You must vacate the property by the finish time and return the keys to us at the place stipulated in the booking confirmation letter. You agree that if you fail to do so you may cause us to incur extra costs. If you vacate later than this finish time you will pay us a late return fee of a minimum of an extra day's rate, together with any costs or loss of profits and damages that we may incur as a result of the delay.
You agree to leave the property in a clean condition. If you fail to do this, we may impose a cleaning charge. You may not remove anything from the property that was there on your arrival. We have an inventory of all contents of the property.
When you leave, you will follow all special instructions in the property manual. This may include that you make sure that all heating and cooling, electric blankets, appliances, burners and lights are switched off.
We will inspect the property after your rental finishes. You agree that you will pay for any damage to the property beyond normal wear and tear, or any losses, or excess cleaning required as a result of your use. You will also pay our costs in arranging for these.
NUMBER OF GUESTS
You agree that you will not have more guests to stay in the property at any time during your rental period than specified in the confirmation letter. This includes the grounds of the property. Caravans and tents are not allowed without prior written permission.
CHILDREN
Some properties are not suitable for children under five years old. This is clearly stated in the booking confirmation letter. If you decide to bring children under five to one of these properties you do so entirely at your own risk.
PETS
You must not bring pets onto the property unless the booking confirmation letter specifically says that they are allowed. On properties where they are allowed, you may bring up to two dogs or cats, as specified on HolidayMakers' website, provided that you obtain prior permission from HolidayMakers. You are entirely responsible for the behaviour of the pets and must not allow them to cause a disturbance or damage any part of the property. You must remove all dog faeces from the garden and surrounds. Failure to clean up after your pet will incur a minimum charge of $100.
ADDITIONAL CHARGES
1 You agree that you will not allow smoking inside the property at any time. We will automatically deduct a minimum of $200 from your bond for additional cleaning if smoking has occurred. You will also face a potential claim for damages.
2 Requests for assistance or maintenance that is of the guests' making will incur a minimum charge of $50 per hour.
YOUR OTHER OBLIGATIONS
You also agree that you:
. Will not part with possession of the property or assign this agreement.
Will only use the property for the purposes of holiday accommodation and for no other purpose.
Will be responsible for the property at all times during your rental including the times that you leave the property unoccupied. Please note that the insurance requires that all doors and windows be locked whenever you leave the property.
Will make sure that any wood fires are always under supervision, or have fire-guards in place and are in a safe condition when they are left unattended.
Will tell us immediately if you do any damage, or if any part of the property needs repair.
Will not attempt repairs and shall be responsible for the consequences of unauthorised repairs.
Will not take firearms onto the property.
INSURANCE
The property is covered by risk insurance which covers fire, storm and tempest damage, third party damage and public risk. You agree that you will not commit any act which would invalidate the Insurance Policy.
EARLY TERMINATION OF RENTAL
You agree that we have the right at all times to bring this agreement to an end and repossess the property without refund to you if:
the property is incorrectly used so as to endanger the property and its occupants or any other property or life;
you or any member of your party behaves in a manner which is likely to prejudicially affect our or the owners interest in the property or the goodwill of our business. This includes excessive noise or disturbance, or having more people on the property than the house allows.
INDEMNITIES
You agree to indemnify and hold us harmless against any loss or damage which arises out of the use of the property by you that is in breach of these terms and conditions or through negligence by you or any member of your party.
You understand that you will be liable for all consequential loss in addition to the usual remedies available at law including loss of income where the property is put out of operation and cannot be used for subsequent rental periods as a result of the breach of these terms and conditions by you, or as a result of negligence by you or any member of your party.
You and the members of your party use the property at your own risk and neither we nor the property owner accept any responsibility for accidents, injuries or death due to use of equipment whether provided by us, the property owner or by you. We are also not responsible to any person for loss or damage to any property, personal belongings or personal affects stolen from the property or damaged or otherwise lost during your rental period.

PAYMENT AND KEY PICKUP
Bookings require a 50 per cent deposit within seven days, and the balance is due 14 days before your holiday starts, or 30 days before for peak times.
When you pay the deposit, we will send you an agreement to confirm all the details. With this you will receive information about key pick up and directions to the property.
We accept Visa and Mastercard, EFT or cheques (when paid in advance). Amex and Diners attract a 3 per cent surcharge.

We collect information from our website, from emails, phone calls and letters, and visits to our office. You do not have to provide any details unless you wish to.
If you wish to book with us, we must have your name, address and contact details.
What we do with your details:
We keep your details on our computer database and use the information to send you details of our holiday options. You may request to be removed from our database at any time if you do not have a current reservation with us.
To whom do we disclose this information?
We will comply with any request from the police or other relevant authority, or, in an emergency, to protect the health or safety of our guests or the property.
We may pass your details to our insurers in the event of an accident during your stay.
We do not pass your details to any other organisation or individual for promotional or marketing purposes.
